Please carefully read there terms of use before you start using the Site. In using our Site, you accept these terms and agree to abide by them. Our site is designed, developed and operated by Smiths Equipment Hire Ltd (“we”, “us” and “our”). We are a limited company in England under the company number 992884 and our registered office (and trading address) is; De Havilland House, 15 & 16 The Pavilions, Avroe Crescent, Blackpool FY4 2DP. Our VAT number is 151 778156.

Any information collected about you on this Site is collected and used by us and us alone, in accordance with our privacy policy.

In using our Site, you agree that we may use personal data in accordance with our privacy policy.

Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable to you if for any reason our Site is unavailable at any time or for any period.

On occasion, we may restrict access to some parts of our Site, or our entire Site.

Submitting Content via Our Site

Ownership.
If you submit content to our Site (including without limitation any text & documents), you grant Us a licence to use, reproduce, modify, adapt, publish, create derivative works from, distribute and display in public that content in any form and media on or in connection with the Site, at no cost to us and for as long as we require and you warrant that you own or have rights to the intellectual property in such content and have the right to grant this licence. You waive any moral rights in your contribution. You will indemnify us and keep us indemnified from and against all costs, claims, damages and expenses made against or incurred by us as a result of a third party alleging that the use of such content by us infringes the intellectual property rights of a third party.

Submissions.
When submitting content, you agree not to do any of the following:

  • upload or transmit material that you do not have a right to make available under any law or contractual or fiduciary relationship (such as confidential information);
  • upload or transmit any computer viruses, macro viruses, Trojan horses, worms, corrupted files or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or other electronic device;
  • use the system of uploading or transmitting content (or any part thereof) in a way that may cause the system (or the servers or networks connected to the system) to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the system is in any way impaired;
  • where you are not the author of any material you are uploading or transmitting, delete any author attributions, legal notices or proprietary designations within the material.

Violation of these Submission terms will result in immediate action which will result in (but not limited to);

  • deletion of content and refusal of future services hosted on the Site;
  • criminal prosecution should content violate points 2, 6 & 7 stated above.
Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Site, and in the material published on it – where such material is not used under the GNU General Public License

Viruses, Hacking and Other Offences

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Jurisdiction and applicable law

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to or use of our Site although we retain the right to bring proceedings against you for breach of these terms of use in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England.
